1. The Controller processes personal data that you have provided or personal data obtained based on the fulfillment of your order:

2. The Controller processes your identification and contact details, as well as data necessary for fulfilling the contract.

III. Legal Basis and Purpose of Processing Personal Data
1. The legal basis for processing personal data is:
◦ Fulfillment of a contract between you and the Controller under Article 6(1)(b) GDPR,
◦ Compliance with a legal obligation of the Controller under Article 6(1)(c) GDPR,
◦ Legitimate interests of the Controller in providing direct marketing (especially for sending commercial communications and newsletters) under Article 6(1)(f) GDPR,
◦ Your consent to the processing for direct marketing purposes (especially for sending commercial communications and newsletters) under Article 6(1)(a) GDPR in connection with Section 7(2) of Act No. 480/2004 Coll. on certain services of the information society, in cases where no order for goods or services has been made.
2. The purposes of processing personal data are:
◦ To process your order and fulfill the rights and obligations arising from the contractual relationship between you and the Controller; when placing an order, personal data necessary for successful order fulfillment (name, address, contact) is required. Providing personal data is a necessary requirement for the conclusion and fulfillment of the contract; without providing personal data, the contract cannot be concluded or fulfilled by the Controller,
◦ Compliance with legal obligations to the state,
◦ Sending commercial communications and conducting other marketing activities.
3. The Controller does not engage in automated individual decision-making as defined in Article 22 GDPR.

IV. Data Retention Period
1. The Controller retains personal data:
◦ For the duration necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and to assert claims arising from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
◦ For the duration until consent to the processing of personal data for marketing purposes is revoked, for a maximum of 10 years if the personal data is processed based on consent.
2. After the expiration of the retention period, the Controller will delete the personal data.
V. Recipients of Personal Data (Subcontractors of the Controller)
1. Recipients of personal data include:
◦ Parties involved in the delivery of goods/services/payment processing based on the contract,
◦ Providers of e-shop operation services (Shoptet) and other related services,
◦ Providers of marketing services.
2. The Controller intends to transfer personal data to a third country (outside the EU) or to an international organization. Recipients of personal data in third countries include mailing service providers and cloud service providers.

VI. Processors of Personal Data
1. Personal data processing is conducted by the Controller; however, the following processors may also process personal data on behalf of the Controller:
◦ Mailchimp,
◦ Companies such as Google and Facebook,
◦ Potentially other providers of processing software and services that the Controller is not currently utilizing.

VII. Your Rights
1. Under the conditions stipulated in the GDPR, you have the right to:
◦ Access your personal data under Article 15 GDPR,
◦ Rectify your personal data under Article 16 GDPR or restrict processing under Article 18 GDPR,
◦ Erase personal data under Article 17 GDPR,
◦ Object to processing under Article 21 GDPR,
◦ Data portability under Article 20 GDPR,
◦ Withdraw your consent to processing either in writing or electronically to the address or email of the Controller specified in Article III of this policy.
2. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated, or to seek judicial recourse.

VIII. Data Security Measures
1. The Controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
2. The Controller has adopted technical measures to secure data storage and personal data stored in physical format.
3. The Controller declares that personal data is accessible only to authorized personnel.
IX. Final Provisions
1. By submitting an order through the online order form, you confirm that you are familiar with the privacy policy and accept it in its entirety.
